Do I need consent for an illuminated sign in Hamilton?District Plan Chapter 25.10, heritage and building consent
Hamilton City Council manages signs through Chapter 25.10 (Signs) of the Hamilton Operative District Plan. The points below come from the version of the chapter dated 18 October 2017, so later plan changes may apply – confirm with the council. According to that text:
- Static illuminated signs are classed as low-intensity signs and are a permitted activity if they meet the standards. Flashing, moving or animated (high-intensity) signs are a discretionary activity and need resource consent.
- Brightness: an illuminated sign must not exceed 1,000 cd/m² (signs under 10 m²), or 600 cd/m² in residential, special character and open space zones and for faces that look directly along or at a road, intersection or railway crossing.
- Size in the Central City, Business and Industrial zones: up to 1 m² of signage for every metre of site frontage, and no higher than the parapet or facade of the building.
- Traffic safety: signs must not look like traffic signs, use flashing or revolving lights that dazzle drivers, or block sight lines at intersections and driveways.
- Inside the shop: signs that cannot be seen from outside the site do not have to meet these sign standards (light-spill rules still apply).
- Heritage: low-intensity signs on scheduled historic heritage buildings and archaeological or cultural sites are a restricted discretionary activity.
- Council land and state highways: signs on council land are controlled by the council's public places bylaw, and signs on state highways by NZTA.
Building consent: under Schedule 1 of the Building Act 2004, a sign generally does not need a building consent if no face is larger than 6 m² and its top is no more than 3 m above the ground, or if a chartered professional engineer designs or reviews it. Larger or higher signs need a building consent, and exempt signs must still meet the Building Code and the district plan.
